§ 1 Scope
These General Terms and Conditions (hereinafter "T&C") apply to all contracts concluded between Family & Service GmbH (brand: Grace' Routine), Auf dem Kamp 1, 27721 Ritterhude (hereinafter "Provider"), and the customer (hereinafter "Customer") via the online shop at graceroutine.com.
These T&C apply exclusively. Deviating conditions of the Customer shall not be recognised unless the Provider expressly agrees to their validity in writing.
§ 2 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to the Customer to place orders.
By clicking the button "Order with obligation to pay", the Customer submits a binding offer to purchase the products in the shopping cart. The confirmation of receipt of the order does not yet constitute acceptance of the offer.
The contract is only concluded when the Provider accepts the order by means of a separate order confirmation or by delivery of the goods.
§ 3 Prices and Shipping Costs
All stated prices are final prices in euros and include the statutory VAT.
In addition to the product prices, shipping costs may apply unless otherwise stated. The amount of the shipping costs will be communicated to the Customer before completing the order and on our "Shipping & Payment" page.
For deliveries to countries outside the EU, customs duties, taxes and fees may apply, which are to be borne by the Customer.
§ 4 Payment
The Customer may use the payment methods specified during the ordering process. Processing is carried out via external payment service providers.
For payment by credit card, the charge is made upon order confirmation. For payment via PayPal or Klarna, the respective provider's terms of use additionally apply.
§ 5 Delivery
Delivery is made to the delivery address specified by the Customer within Germany and to selected EU countries.
The applicable delivery times are displayed on the product pages and during the ordering process.
In the event of temporary unavailability of a product, the Provider will inform the Customer immediately and refund any payments already made without delay.
§ 6 Retention of Title
The delivered goods remain the property of the Provider until full payment has been received.
§ 7 Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal. The details are set out in the separate withdrawal policy, which forms part of these T&C.
§ 8 Warranty
The statutory warranty rights apply. The warranty period for new goods is two years from receipt of the goods.

§ 9 Liability
The Provider is liable without limitation for damages arising from injury to life, body or health, as well as for damages caused intentionally or through gross negligence.
For damages caused by slight negligence, the Provider is only liable in the event of a breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, contract-typical damage.
Liability under the Product Liability Act remains unaffected.
§ 10 Set-off and Retention
The Customer is only entitled to set-off if their counterclaims have been legally established or are undisputed. The Customer may only exercise a right of retention insofar as their counterclaim is based on the same contractual relationship.
§ 11 Applicable Law and Language of Contract
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the Customer is a consumer habitually resident in an EU member state, the mandatory consumer protection provisions of the country of residence shall additionally apply, provided these are more favourable to the Customer.
The language of the contract is German.
§ 12 Severability Clause
Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall not be affected. In place of the invalid provision, such a valid regulation shall apply that comes closest to the economic purpose of the invalid provision.
